HOW DO WE COLLECT YOUR PERSONAL INFORMATION?

  1. Near you.

You provide us with personal information directly, such as when you contact us, when you make a purchase from us, when you fill out an online form or when you click on an advertisement we have placed on a third-party website (e.g. Google, Facebook, etc.).

  1. From other sources

We may also collect personal information from third parties, or from publicly available records, to the extent permitted by law or where we have obtained the necessary consent.

  1. From cookies, log files, web beacons, tags or pixels.

By using cookies, pixels, and other similar tools, we are able to provide you with ads that are more relevant to your needs because they are targeted based on your interests. When you visit our website, these tools tell us, among other things, which pages you are interested in and, as a result, we can then display ads that match your interests.

* Details of the collection, use and disclosure of data on our Site through cookies, log files, web beacons, pixels, tags or similar tools.

As mentioned above, by using cookies and other similar technologies, we are able to offer you advertising that is more relevant to your needs, since it is targeted according to your interests and preferences. When you visit our Site, cookies tell us, among other things, which pages interest you and, consequently, we can subsequently display advertising or recommendations that match your interests. These technologies do not contain any personal information that can identify you per se. However, they may contain a unique identifier necessary for profiling.

Invisible pixels

Web beacons are tiny images that we may place on our web pages or emails. They can be used, for example, to anonymously track the number of times a particular page has been visited by a user or whether an email has been accepted. As the name suggests, web beacons are invisible, and any part of our Site, including advertising messages displayed on it, may contain web beacons. Unlike cookies, web beacons are not placed on your computer.

Cookies

Cookies are small data files that are commonly stored on your device when using websites and online services. They are used for the efficient operation of websites and can provide information and help personalize services. Oleka Canvas collects information provided by cookies. Oleka Canvas uses different types of cookies (collectively referred to herein as cookies).

Necessary cookies

These cookies are essential for the operation of our Site and our online store. For example, we may use this type of cookie to authenticate and identify you when you are logged in to our Site in order to provide you with our services. These cookies also allow us to enforce our Terms of Use, prevent fraud, and ensure the security of our services.

Performance and functionality cookies

These cookies are not essential to the provision of our services. They facilitate personalization and improvement of the user experience. For example, they can remember your preferences and avoid you having to re-enter information more than once. They allow us to understand your behavior in order to improve our Sites.

Cookies for advertising purposes

These cookies are not essential to the provision of our services. They use information about your visit to our Sites, such as pages viewed or response to advertisements, to help provide the best user experience for you. The length of time a cookie is stored on your computer or mobile device depends on whether it is a "persistent" or "session" cookie. Session cookies last until you stop browsing, and persistent cookies last until they expire or are deleted. Most of the cookies we use are persistent and have an expiry time ranging from 30 minutes to two years from the date they are downloaded to your device. Please note that the use of cookies only identifies you as a user and does not recognize you by name or address.

Disabling cookies

It is possible to prevent the personalization features of our Site by disabling cookies on your browser. You can do this by changing the settings on your browser or mobile device, which are often found in the "Tools" or "Preferences" menu of your browser. However, if you decide to refuse cookies, some pages or sections of our Sites may not display correctly or certain features may not be available. You can find more information on how to change your browser settings or block, manage, or filter cookies in your browser's help file or on websites such as http://www.allaboutcookies.org/.

Do other sites have access to cookies when you browse our Sites?

We sometimes use third-party service providers. When you access our Site, either directly or through an advertisement that redirects you to it, a cookie is automatically created on your computer or mobile device. At that time, a web analytics tool (for example, Google Analytics) and possibly external ad servers have access to this cookie, which allows us to offer you a better experience on our Site or, in some cases, to track your activity to promote certain of our products and services. Although a code in the cookie allows you to be identified as a user, it does not recognize you by your name or address. Our service providers may also need to collect your IP address or mobile device identifier when you visit a site. This information may be transmitted to and stored on servers located in Canada or elsewhere, for example, in the United States. Oleka Canvas does not combine any information collected by these third parties with information we hold about you. Please note, however, that some providers may be required to share collected data with third parties if legally required to do so, or if they wish to outsource the processing of certain data to third parties. No information that would allow these providers to identify you is shared with them. Please note that third-party service providers have their own cookies and privacy policies.

Use of Google Analytics

Oleka Canvas uses Google Analytics, which is provided by Google Inc. (Google), to analyze the browsing behavior of visitors to its Site, which is a tool for analyzing website traffic and usage. The information collected by Google Analytics is used to analyze the use of our Site and to produce statistical reports on visitor activity. You can find more information about Google Analytics here.

Targeted advertising

Oleka Canvas also collaborates with third-party advertising companies, such as Facebook or Google Adwords, which collect and use information about your visits to our Sites to present you with advertising that may be of interest to you. Oleka Canvas does not share any information that allows advertising companies to identify you. Please note that our advertising partners and other third parties may also install cookies or web beacons when you click on their advertisements or links to their websites or services on our Sites. This Privacy Policy does not apply to third-party websites or to these third-party advertising providers. You can opt out of Google Analytics during your navigation by selecting the appropriate settings on your browser or computer, as well as through the ad settings. You can opt out of sharing your information with these third parties by installing an add-on that allows you to opt out of receiving interest-based ads. In addition, you can opt out of some of these services by visiting the Digital Advertising Alliance's opt-out portal at the following address: http://optout.aboutads.info/. Oleka Canvas also uses Facebook's Custom Audiences feature to target interest-based advertising to its current and potential customers. We encourage you to review your Facebook privacy settings if you wish to manage your advertising settings. You can find more information here. Please note that even if you opt out of receiving interest-based advertising, you will still be able to see Oleka Canvas ads. In this case, these ads simply will not be tailored to your actual needs and may be displayed more frequently. For more information on how interest-based advertising works, you can visit the Network Advertising Initiative's ("NAI") educational page at: http://www.networkadvertising.org/understanding-online-advertising/how-does-it-work.

Social Media Features

Our Services include social media features like the Pinterest, Instagram, or Facebook share button or interactive mini-programs that run on our Sites. If you use these features, they collect your IP address, which page you are visiting on our Sites, and set a cookie to enable these features to function properly. These features may be hosted by a third party or hosted directly on our Sites. Your interaction with these features is governed by the privacy policy of the company that provides the feature, not this policy.

Link to Websites

It is important to understand that this Policy does not apply to other third-party websites that may be accessed from links on our Site. We are not responsible for these third-party sites, their content, or access to them. Therefore, any personal information you submit through these sites is subject to their privacy policies. It is your responsibility to review them to ensure the protection of your personal information.

HOW DO WE COMMUNICATE AND SHARE YOUR PERSONAL INFORMATION?

As part of our business, we need to communicate and share your personal information with various parties. We will only communicate or share your personal information in the ways described below:

Agents and Third Party Service Providers

We may sometimes need to share your personal information with agents or service providers to help us make available all the features of our Site (maintenance, analysis, legal requirements, fraud detection, marketing and development). Please note that these may be located in Canada or in other jurisdictions or countries. They will only have access to the personal information that is necessary to perform these tasks on our behalf and they are obligated not to disclose or use it for any other purpose. Please be aware that we have contractual agreements with these providers to ensure the security of your data. For example, we use Shopify to power our online store. You can learn more about how Shopify uses your personal information here: https://www.shopify.com/legal/privacy.

When required by law, to enforce rules, or to protect our or others' property or safety

For example, we may disclose Personal Information to legal or regulatory authorities if we suspect money laundering, insider trading, manipulative or deceptive marketing practices, or other criminal activities, to detect and prevent fraud, or to comply with the requirements of legislation or regulations of government bodies, regulatory bodies, or other self-regulatory organizations. We may also disclose Personal Information to comply with a legal obligation (e.g., a court order) or to protect our assets (e.g., to collect overdue accounts).

Business transfer

As we continue to develop our business, we might sell or buy businesses or services. In such transactions, personal information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing privacy policy (unless, of course, the individual consents otherwise). In addition, in the unlikely event that Oleka Canvas or substantially all of its assets are acquired, your information will, of course, be one of the transferred assets.

Anonymously

Anonymized personal information may be shared with third parties. For example, we may anonymize personal information to establish trends or statistics.

HOW DO WE PROTECT YOUR PERSONAL INFORMATION?

The security and confidentiality of your personal information are important to us. We strive to implement the necessary and appropriate security measures to ensure the confidentiality of the personal information in our possession. To do this, we follow generally accepted industry standards. The personal information we hold is therefore only accessible to those who have the authority to view it and who consult it only when necessary in the performance of their duties. Appropriate physical, technical and/or administrative protection and security measures have been implemented and are maintained to prevent:

  • Any accidental or non-compliant destruction;
  • Any accidental loss;
  • Any unauthorized disclosure;
  • Any unauthorized modification;
  • Any unauthorized access; and
  • Any illegal processing.

To do this, we ensure, in particular, that we restrict access to our offices and computer equipment, train our staff and require our agents and suppliers of goods and services who have access to personal information to sign confidentiality agreements and implement security measures deemed equivalent. If you believe that your personal information has been compromised, we invite you to contact us using the contact information listed in the “Questions, comments, complaints” section of this Policy.

HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?

We only retain your personal information for as long as it is necessary for our business relationship, in accordance with our internal document retention policies or legal and regulatory requirements. Strict procedures for the retention of your personal information are followed and we will destroy personal information that Oleka Canvas no longer requires for the identified purposes. If you would like additional information, we invite you to contact us using the contact details provided in the “Questions, Comments, Complaints” section of this Policy.

WHAT ARE YOUR RIGHTS?

Right of access, information and rectification of your personal information

You may request access to your personal information or inquire about the existence of such information or how we collect, use, store, and/or disclose your personal information. You may also request that the information held by Oleka Canvas be corrected if it is found to be inaccurate, ambiguous, or incomplete. You may submit a written request to this effect to the Privacy Officer at the address indicated in the “Questions, Comments, Complaints” section below.

We will provide you with this information or make the change promptly and no later than 30 days after the date of receipt of the written request. If you wish to obtain copies of your personal information, we may have to charge a small fee, which will be communicated to you in advance, simply to cover the costs of transcription, reproduction or transmission.

Under privacy and data protection legislation, you have rights that we must inform you of. Your rights depend on the reason we are processing your information.

Right of access and rectification

You have the right to ask us for copies of your personal information. This right still applies. There are certain exemptions, which means you may not always receive all the information we process. You also have the right to ask us to rectify information you think is inaccurate and to ask us to complete information you think is incomplete. These rights still apply.

Right to erasure

You have the right to ask us to erase your personal information in certain circumstances.

Right to object, limit or restrict the use of personal information

You can ask us to stop using all or some of your personal information (for example, if we have no legal right to continue using it) or to limit our use of it (for example, if your personal information is inaccurate or unlawfully held).

Right to data portability

This right only applies to information you have provided to us. You have the right to request that we transfer the information you have given us from one organization to another, or to hand it over to you. This right only applies if we process the information based on your consent or in the context of, or with a view to entering into, a contract and the processing is automated. If you would like to make a request, please submit a written request to the Privacy Officer at the address provided in the "Questions, Comments, Complaints" section below. In most cases, you are not required to pay a fee to exercise your rights. Under applicable law, we normally have one month to respond to you.

Automated decision-making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), where that decision has a legal effect on you or otherwise significantly affects you. We do not make fully automated decisions with a legal or otherwise significant effect using customer data. Our provider, Shopify, uses limited automated decision-making to prevent fraud, which does not have a legal or otherwise significant effect on you. Services that include elements of automated decision-making include:

  • A temporary deny list of IP addresses associated with repeated failed transactions. This deny list persists for a small number of hours.
  • A temporary list of credit cards associated with declined IP addresses. This list is kept for a small number of days.

POLICY CHANGES AND UPDATES

The content of our Site may change at any time, and Oleka Canvas reserves the right, at its sole discretion, to update, revise, modify, or supplement this Policy from time to time.
